These Terms of Service (“Terms”) govern your use of north43degrees.com and any purchases made through our online store.

Throughout these Terms, “NORTH 43°”, “we”, “us” and “our” refer to North43Degrees, trading as NORTH 43°.

By accessing our website or placing an order with us, you agree to these Terms.

Nothing in these Terms affects your statutory rights as a consumer.

2. OUR ONLINE STORE

Our store is hosted using Shopify, which provides the ecommerce platform that allows us to offer and sell our products online.

You may use our website only for lawful purposes.

You must not use our website:

For fraudulent or unlawful activity
To interfere with or disrupt the operation or security of the website
To transmit malicious software, viruses or harmful code
To attempt to gain unauthorised access to our systems
To infringe the rights of NORTH 43° or another person

We reserve the right to restrict access to our website where reasonably necessary to protect our business, customers or systems.

3. PRODUCTS

We aim to describe and display our products as accurately as reasonably possible.

However, colours and appearance may vary slightly depending on your device, screen settings, lighting and photography.

Product measurements and sizing information are provided as a guide. Small manufacturing tolerances may occur between individual garments.

Nothing in this section affects your rights where a product is faulty, not as described or otherwise fails to meet applicable legal requirements.

4. AVAILABILITY

All products are subject to availability.

Adding an item to your basket does not reserve that item.

We may introduce, discontinue or change products offered through our website.

If a product becomes unavailable after you have placed an order and we cannot fulfil it, we will contact you and refund any amount paid for the unavailable product.

5. PRICING

Prices are displayed in the currency shown on our website.

The total price payable, including applicable delivery charges and taxes where relevant, will be shown before you complete your purchase.

We make reasonable efforts to ensure prices are accurate.

If we discover an obvious pricing error after an order has been placed, we will contact you before fulfilling the affected item. You will have the option to proceed at the correct price or cancel the affected item for a full refund.

We will not increase the agreed price of an order after a contract has been formed.

6. PLACING AN ORDER

When you place an order, you are offering to purchase the products in your basket.

You are responsible for checking that your order details, including products, sizes, quantities, delivery address and contact information, are correct before submitting your order.

After placing an order, you will receive an order confirmation electronically.

If we are unable to accept or fulfil an order, we will notify you and refund any payment we have taken for the affected products.

7. PAYMENT

Payment must be made using one of the payment methods available at checkout.

You agree to provide accurate and complete payment and billing information.

Payment services may be provided by third-party payment providers. Your use of those payment methods may also be subject to the provider’s own terms and privacy policies.

8. DELIVERY

Available delivery options, estimated timescales and applicable charges will be displayed during checkout.

Please ensure that your delivery address is accurate before completing your order.

Estimated delivery dates are estimates rather than guaranteed dates unless we expressly agree otherwise.

Where applicable law requires us to deliver within a particular period, your statutory rights remain unaffected.

9. RETURNS & REFUNDS

NORTH 43° offers eligible customers a 30-day returns period from receipt of their order, subject to our Returns & Refunds Policy.

Our voluntary 30-day returns policy is in addition to, and does not replace, your statutory rights.

Unless an item is faulty, damaged or incorrect, customers are responsible for return postage in accordance with our Returns & Refunds Policy.

10. CANCELLATION RIGHTS

Customers purchasing online may have statutory rights to cancel eligible purchases.

Our 30-day returns policy provides additional time for eligible returns but does not reduce or replace any statutory cancellation rights available to you.

Include your name, order number and details of the products concerned.

Certain products may be excluded from statutory cancellation rights, including certain personalised or custom-made products.

11. FAULTY, DAMAGED OR INCORRECT PRODUCTS

Products supplied by NORTH 43° must meet the standards required by applicable consumer law.

If you receive something that is faulty, damaged, not as described or different from what you ordered, please contact:

Include your order number, a description of the problem and photographs where relevant.

We’ll review the issue and provide an appropriate remedy in accordance with your legal rights.

Nothing in these Terms excludes or restricts your statutory rights relating to faulty or misdescribed goods.

12. PROMOTIONS & DISCOUNT CODES

From time to time, NORTH 43° may offer promotional codes, discounts or other offers.

Unless stated otherwise:

Promotional codes cannot be exchanged for cash
A promotion may have an expiry date
Additional eligibility requirements may apply
Only one promotional code may be used per order unless expressly stated otherwise

Any specific terms displayed with a promotion will apply alongside these Terms.

We may refuse or cancel the use of a promotional code where we reasonably believe it has been obtained, distributed or used fraudulently or contrary to the terms of the promotion.

13. GIFT CARDS

Where offered, NORTH 43° gift cards may be subject to additional conditions displayed when they are purchased.

Gift cards cannot normally be exchanged for cash except where required by law.

14. INTELLECTUAL PROPERTY

Unless otherwise stated, content appearing on north43degrees.com is owned by, licensed to or used with permission by NORTH 43°.

This includes, where applicable:

Logos
The N43° monogram
Product designs and graphics
Photography
Video
Written content
Website graphics
Artwork

You may view and use our website for your personal, non-commercial use.

You must not reproduce, sell, commercially exploit or distribute NORTH 43° intellectual property without permission, except where permitted by law.

15. USER CONTENT

If you send, submit or tag NORTH 43° in photographs, videos, reviews or other content, you retain ownership of your content.

We will not treat merely tagging or mentioning NORTH 43° as permission to use your content commercially.

Where we would like to reproduce customer-created content for our own marketing, we may contact you to request permission.

16. REVIEWS

Reviews and other customer content should reflect genuine experiences and opinions.

You must not knowingly submit fake, misleading, fraudulent, abusive or unlawful reviews or content.

We may moderate content where reasonably necessary, including where it contains unlawful material, personal information, spam or content unrelated to the product or service being reviewed.

We will not remove or suppress genuine negative reviews simply because they are critical of NORTH 43°.

Our website may contain links to, integrations with or services provided by third parties.

These may include payment providers, delivery companies, social networks and other service providers.

Third-party websites and services operate under their own terms and policies.

NORTH 43° is not responsible for the content or independent operation of third-party websites that we do not control.

This does not exclude responsibility that the law places on NORTH 43° for parties we use to fulfil our obligations to you.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or limits your statutory rights regarding products that are faulty, not as described or otherwise fail to meet legal requirements.

We do not exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded.

NORTH 43° is not responsible for losses that were not reasonably foreseeable when the contract was formed, except where applicable law provides otherwise.

If you are purchasing products primarily for business purposes rather than as a consumer, different legal rights may apply.

21. SEVERABILITY

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

These Terms and purchases made through NORTH 43° are governed by the applicable laws of the United Kingdom.

If you are a consumer, you retain any mandatory protections and rights regarding where proceedings may be brought that are available to you under applicable law.
